Standard Rental Agreement
(Terms and Conditions)
A minimum booking fee of $200 per vehicle is required to secure a booking
All reservations must be confirmed with a booking fee of $200. By making payment of your booking fee it is deemed that you have read, understood and agree to these terms and conditions. All payments are non-refundable in the event that the client cancels, changes their mind, or in the event of an epidemic, pandemic or government shutdown, but the opportunity to reschedule will be offered at the discretion of Lolly’s Limousine. A booking confirmation will be issued at the time of booking noting the booking fee has been paid. This booking fee will come off the total cost of your booking.
The balance of the account
The balance owing is required 14 days prior to the event. Surcharges of 2% apply to all credit card payments. Payment of the booking fee is acceptance of the terms and conditions of the hiring of the service and an acknowledgement of responsibility and liability for the full balance due.
Hire agreements can only be made by persons aged 18 years of age or over
The hiring customer will be held responsible for the conduct of all passengers within their party. The hiring customer is responsible to ensure all passengers are aware of the conditions, and is also responsible for any damage to the exterior, the interior and the contents of the vehicle.
Lolly’s Limousine reserves the right to terminate the charter immediately, without refund if passengers become unruly, abusive or are not in a fit state to travel. Where a student under the age of 18 makes an enquiry for a school ball, a parent/guardian must enter into the agreement on the student’s behalf.
All vehicles are non-smoking
Should this condition be ignored the drivers are instructed to terminate the charter immediately, without refund if a member of your party smokes in the vehicle.
Drug use is prohibited by law. The driver has the right to terminate run without refund if there is blatant indiscretion on the part of the client.
Photography featuring the vehicles is permitted and the drivers will assist to position the vehicles as requested by the photographer. The drivers have the final decision on how the vehicles can or will be placed at a location.
Photographs featuring the vehicles and event may be taken by Lolly’s Limousine drivers for promotional use by Lolly’s Limousine. Copyright for these images belongs to Lolly’s Limousine and they are available free of charge to the person responsible for the hire. Please note images taken by our drivers are amateur and low quality, we recommend that you hire a professional photographer for your event.
Seat-belts and seating capacity
As per the South Australian Road Traffic Act, all passengers in the vehicle must always wear the provided seat belts. The seating capacity of modern stretch limousines is based on the number of seat belts, spaced 400mm apart, installed in the vehicle and based on the average height and weight of an Australian male being 175cm tall and 86kg. Vehicles cannot be loaded beyond seating capacity.
Changes to the schedule
Changes to a booking schedule can to be communicated to Lolly’s Limousine either verbally or by email. Please ensure that all changes to the schedule are reflected in the final confirmation email you receive the week of your booking. Changes made in the week preceding the booking, after the drivers are scheduled, can lead to the confusion of duplicate instructions and are best avoided whenever possible.
Final confirmation of the schedule is given to Lolly’s Limousine the week of the booking. If you require any changes to your booking please ensure you do so in writing via email.
Bespoke orders and arrangements
There will be no refunds for bespoke orders/items when cancelling or rescheduling dates. Perishables and custom orders will be delivered to the customer and any credit for other items is given at the discretion of Lolly’s Limousine.
In the case that the booking runs overtime due to client punctuality, charges of $75 per 15 mins or part thereof as agreed will apply. Overtime rates will not apply for unforeseen circumstances such as traffic. Running overtime can be a source of frustration for drivers who may have commitments following your booking, so we recommend that you build some time into your booking schedule for unexpected delays on the day. You, the hiring customer agree to have all attendees at the designated pickup point(s) at the arranged time(s). If not, you accept that the vehicle may not be able to wait, and late attendees may be left behind. No refund will be given. Refunds will not be given upon early completion of the pre-booked times. You, the hiring customer, agree to pay by credit card or cash all follow up charges for overtime.
Time permitting; the Driver may be willing to collect additional passengers, subject to the maximum that the Vehicle can carry, at alternative locations. However, any additional mileage or time shall be charged to the Hiring customer. Whilst the driver will attempt to accommodate any last minute changes, the final decision will remain with the driver and the hiring customer expressly accepts this arrangement.
In the event that the time or location of the hire is changed prior to the booking or at the time of the booking, Lolly’s Limousine expressly reserves the right to make any additional charges and to set such charges against the hiring customer’s deposit or credit card. It is the Hiring customer’s responsibility to confirm with Lolly’s Limousine or the Driver current charges for additional hours and excess mileage, any failure to do so will not derogate the Hiring customer’s responsibility to pay the charges.
Safety is a priority.
All attendees must follow directions given by the driver. Refusal and failure to do so will result in termination of the charter immediately without refund.
Irresponsible behaviour which could give rise to damage to the Vehicle or endanger the safety of the other passengers will not be tolerated in any form. This includes, but is not restricted to; sitting on the exterior of the vehicle, hanging out of the windows, shouting abuse to other road users or pedestrians out of the window, rudeness or intolerance with the Driver, misuse of the equipment, fixtures or consumables within the vehicle and wilful damage to the interior generally. Such behaviour may, at the sole discretion of the driver, result in the immediate termination of the charter without compensation. In addition, the hiring customer shall be held liable and responsible for any loss, howsoever caused, by the irresponsible behaviour of his or her party.
The hiring customer expressly accepts that except in cases of an emergency, only the Driver may open and close doors, this is a safety precaution to minimise the risk of accidents and damage to the vehicle. Lolly’s Limousine will not be held responsible for accidents caused as a consequence of the hiring customer or his or her party failing to adhere to this condition and the hiring customer accepts for responsibility for any damage to the vehicle and or any third party as a result of the Hiring customer or Hiring customer’s party failing to adhere to this condition.
Limitations of liability
Lolly’s Limousine is not responsible for customer belongings left in the vehicle or lost on the charter.
The Hiring customer accepts and indemnifies Lolly’s Limousine and its employees against any loss, consequential or otherwise as a result, direct or otherwise of a failure to meet time deadlines. It is entirely the responsibility of the Hiring customer to ensure that there is adequate time to travel to and from destinations, Lolly’s Limousine or its employees will provide advice, but this does not form any part of a contract between the Hiring customer, the Hiring customer’s party or Lolly’s Limousine and its Employees.
Furthermore, the Hiring customer indemnifies Lolly’s Limousine against any and all claims as a result, direct or otherwise, consequential or otherwise, of a failure to arrive at the destination at the appropriate time or at all.
The Hiring customer expressly accepts that in car entertainment such as television screens, video and DVD equipment is provided as a courtesy and its use and/or availability does not form part of the Hire. In the event that any equipment fitted to the Vehicle malfunctions prior to or during the hire, Lolly’s Limousine accepts no liability whatsoever and no compensation shall be provided in such instances, nor will Lolly’s Limousine accept any claims for any form of refund.
In the event that a vehicle is subject to an accident or mechanical failure, or is no longer safe to drive, then Lolly’s Limousine shall make alternative arrangements to get the Hiring customer and his or her party to their destination. Lolly’s Limousine may at its entire discretion determine the method of onward travel, alternatively the Hiring customer, or his or her party may make alternative arrangements at their cost, for which no claim can be made against Lolly’s Limousine. The Hiring customer specifically accepts that the Hire is based on a best endeavours basis and therefore, no specific guarantees can be made in terms of time, reliability of the Vehicle and events out our of the direct control of the Driver or Lolly’s Limousine.
Lolly’s Limousine assumes no responsibility nor does it provide any guarantees whatsoever for ensuring that the Hiring customer arrives at his or her destination on time. It is entirely the responsibility of the Hiring customer to determine whether the Vehicle has been hired for a period sufficient to cover eventualities such as, but not limited to, traffic accidents, roadworks and peak traffic periods. In addition, the Hiring customer is responsible for ensuring that the Hire commences at a time which allows for such eventualities. Lolly’s Limousine will not provide any refunds for such eventualities and any additional time over and above the Booking period shall be charged at the appropriate rate.
Where time is critical, this includes, but is not limited to Weddings, Lolly’s Limousine recommends that the Hiring customer allows sufficient time to ensure that no disruption to the schedule is incurred as a result of unexpected or unavoidable delays.
Where Lolly’s Limousine accepts responsibility whether in full or in part for a failure to perform its obligations under the terms of this contract then the extent of any liability shall be limited to the Hire Charge.
Lolly’s Limousine reserves the right to change the specification of the vehicle at any time, provided that where the replacement vehicle is of a lesser value or specification, an appropriate adjustment is made in favour of the Hiring customer. Lolly’s Limousine undertakes to use its best endeavours to ensure that the Vehicle booked is the one provided for the hire.
Although Lolly’s Limousine rarely does so, Lolly’s Limousine reserves the right to sub-contract any Hire to a third party without reference to the Hiring customer, in such circumstances Lolly’s Limousine shall be responsible for payment to the 3rd party of charges relating to the standard Hire. However, in the event that any additional services are provided, which include, but are not limited to, excess mileage, additional hours or damage to the Vehicle then Lolly’s Limousine retains all rights to charge the Hiring customer.
Any claim for liquidated damages, consequential loss or any other eventuality shall not be admissible. In all cases, the owners, operators and drivers at Lolly’s Limousine maximum liability shall be limited to a full refund of monies paid pertaining only to the trip in question.
Damage and/or soiling of the cars
Please note we do not allow outside food in our vehicles without prior authorisation from the driver & all vehicles are non-smoking. Should this condition be ignored our driver is authorised to terminate the hire agreement immediately and a refund will not be offered under any circumstances. Damage or soiling of the cars caused by the party (including upholstery damage, spillage and soiling) and the cost of any work that the vehicle is unable to attend will be charged to the hiring customer. You, the hiring customer, agree that all charges for overtime and/or the basic soiling/cleaning fee of $250 will be paid via cash or credit card before completion of the charter and by invoice for excessive follow up charges. The cleaning and sanitising fee for soiling starts at $250, with excessive soiling and damages at cost. Repair costs will be invoiced.
In the event of an unforeseen accident or breakdown
Lolly’s Limousines reserves the right to substitute an alternative vehicle to those booked in the event of an unforeseen accident or breakdown before or during a booking, Lolly’s Limousine is not liable in the event of mechanical breakdown while on charter. In the event that the vehicle is subject to an accident or mechanical failure, or is no longer safe to drive, then Lolly’s Limousine shall endeavour to make alternative arrangements to get the hiring customer’s attendees to their destination. Lolly’s Limousine may at its entire discretion determine the method of onward travel, alternatively the hiring customer’s attendees may make alternative arrangements at their cost, for which no claim can be made against Lolly’s Limousine. The hiring customer specifically accepts that the hire is based on a best endeavours basis and therefore, no specific guarantees can be made in terms of time, reliability of the vehicle and events out of the direct control of the Driver or Lolly’s Limousine. Lolly’s Limousine will not be held liable for compensation beyond the cost of the car hire for the specific vehicle and time not in service. We advise you to take out suitable wedding insurance in case something unforeseeable should disrupt or cause your wedding to be cancelled or postponed at the last minute. Sometimes, particularly on a Friday night, and even though we allow plenty of time, traffic in Adelaide doesn’t allow us to get to your pick up location on time. In this situation, we will do everything we can to make it up to you, but no refunds will be offered.
Pandemic, Government Shutdown, Extreme weather, Dangerous conditions
The safety of our drivers and customers is paramount.
Lolly’s Limousine reserves the right to cancel the booking at any time, for any reason and limits its liability to the monies paid if it chooses to do so.
Lolly’s limousine reserves the right to change or cancel a booking due to extreme circumstances.
Customers are also invited to contact Lolly’s limousine if they are experiencing extreme circumstances.
For example - the scheduled journey is safe - it’s a city pickup and visit to the Barossa but there is bushfire or flood concern elsewhere in Adelaide and this is potentially threatening an attendee’s residence, we understand.
Or a sudden illness and admittance into hospital has stopped your plans, we again understand.
Just let us know, we will cancel immediately and contact you again in 2 to 3 days.
In the first instance Lolly’s limousine will offer rescheduling opportunities and credit. Refunds of any kind will be at the discretion of Lolly’s Limousine.
School ball bookings
It is an offence under the Liquor Control Act 1988 for any person to consume alcohol on board the vehicle when the purpose of the charter is a school-based function, regardless of whether the person consuming the alcohol is 18 years and above or not. Our drivers are authorised to terminate charters immediately if alcohol is being consumed and a refund will not be offered under any circumstances.
Where a student under the age of 18 makes an enquiry for a school ball, a parent/guardian must enter into the agreement on the student’s behalf.
Lolly’s limousine looks forward to hosting your child and their friends. Breakables such as drink glasses will be exchanged for non-breakable or disposable options, and drinks and snacks changed to age appropriate options.
Understandably, the driver will not be able to drive and sufficiently supervise children. The vehicle fits 12 in the back, so depending on ages I recommend children’s parties are kept to 10 reserving up to 2 spaces for supervising adults, other configurations can be negotiated. Children’s parties will need at least one supervising adult on board.
Children will still need to wear their seatbelts and follow rules.
Some accommodations for booster seats can be arranged. Where the Hiring customer has asked for a child seat to be fitted, it is the responsibility of the Hiring customer to supply and ensure that the seat is correctly fitted before placing a child into the seat. If the driver or hiring customer does not consider that the seat provides sufficient protection or that it is not fitted correctly, the driver and hiring customer shall not allow the child to travel.
Extra time will be allocated after a children’s party for cleaning the vehicle. We understand kids can be messier and we will accommodate usual child behaviours, however please read the terms and conditions in regards to excessive soiling and damage to the cars.
Please be aware that there are fragile surfaces and TVs in the vehicle, and while we will make every attempt to remove breakables, damage to these fixed elements will be charged to the hiring customer.
Excessive soiling will incur a cleaning fee.
Due to the length of the stretch limousine, access into some venues, suburban streets and driveways may be restricted and pickup/drop-offs at the front door may not be achievable. Drivers reserve the right to refuse passage to any venue that they deem unsafe to the vehicle or passengers and will instead use the next closest safe pickup/drop off area.
In the event that the hiring customer is a business then that Company shall assume the responsibility and will be bound to advise the party or passengers of the terms and conditions of this hire.
If any term or condition is found to be invalid for any reason whatsoever this shall not deem this agreement to be invalid and all other terms shall remain in force.
Lolly’s Limousine may at its entire discretion refuse any hire without explanation or reason.
The quote expires 7 days after the date of issue or at the discretion of Lolly’s Limousine management to the trip in question.
Lolly’s Limousine reserves the right to cancel the booking at any time, for any reason and limits its liability to the monies paid if it chooses to do so.
